Are Sub-subcontractors (or 2nd-tier subcontractors) required to send a second-month notice?

Effective January 1, 2022, sub-subcontractors are no longer required to send a second-month notice. Now, both subcontractors and sub-subcontractors must send a single notice by the 15th day of the third month following each month in which labor or materials were provided and remain unpaid.


This unified notice must be sent to both the property owner and the original contractor. It's essential to adhere to this deadline to preserve lien rights. For example, if work was performed in January and payment was not received, the notice should be sent by April 15.

These changes aim to simplify the lien process and reduce the administrative burden on subcontractors and sub-subcontractors, ensuring they have a clear and consistent procedure to follow when seeking to secure payment for their services.
